If You are located in the U.S., federal regulations require that SHAiR.CO provides You with certain documents or communications: (1) at the time You contract for services and/or before You use those services for the first time and (2) when You authorize payments; and that the document or communication be in writing in a form that You may keep. The Electronic Signatures in Global and National Commerce Act (E-Sign Act) allows SHAiR.CO to provide You with documents or communications in electronic form rather than in written form and allows You to use Your electronic signature in lieu of signing a paper document if You consent after we have provided You with the following information.

• Scope of Disclosure
  This disclosure (“Disclosure”) applies to all notices, disclosures, statements, and other communications that SHAiR.CO or its affiliates (“carSHAiR”) provide to You regarding SHAiR.CO products and services (“Services”). It also applies to agreements governing Your use of the Services and communications under them. All these communications and agreements are collectively referred to as “Communications."
  
  By submitting an application, opening an account to use the Services, or clicking “I Agree” to our Terms of Service, You agree to this Disclosure and confirm Your consent to (a) receive Communications electronically; and (b) the use of electronic signatures. If You choose not to consent to this Disclosure or if You withdraw Your consent, You may be unable to use the Services.
  
  

• Communications that are covered.
  This Disclosure applies to all Communications that SHAiR.CO provides to You on its behalf or on behalf of its service providers and their affiliates. Examples of Communications include: 

1. Any statement governing Your use of the Services;
2. Any disclosures required by Law; 
3. Purchases, billing statements, and receipts;
4. Letters, notices, and alerts regarding the Services and any changes to the Services;
5. Federal and state tax statements and documents; and
6. Other disclosures, notices, and communications in connection with (a) membership application for the Services, (b) membership account, (c) membership maintenance, or (d) servicing and collection of funds.

• Methods of Providing Communications
  Unless Law otherwise requires, or SHAiR.CO otherwise agrees, We may provide Communications to You by (a) posting them on the SHAiR Website/Application; (b) notifying You through the Services, Your member profile, or any SHAiR.CO application; (c) sending a text message to the mobile phone number listed in the applicable SHAiR Account; (d) sending an email to the email address listed in the applicable SHAiR Account; or (e) delivering them in another electronic format. Charges may apply to Communications sent by text or other electronic means and You consent to receiving such Communications.

• Hardware and Software Requirements
  To access, view, sign, and retain electronic Communications that SHAiR.CO provides You, You must have:

1. An up-to-date device (e.g., computer, tablet, or mobile phone) with internet access;
2. An up-to-date version of the application;
3. A current, compatible web browser, including the current or immediately preceding version of Chrome, Internet Explorer, Firefox, Safari, and Edge;
4. A valid email account;
5. An operating system on Your device capable of receiving, accessing, and displaying Communications in electronic form via text-formatted email or gaining access to the SHAiR website using a supported browser, including any necessary software (e.g., Adobe to read PDF documents); and
6. If You wish to store or print any Communications, a device capable of storing and printing Communications and sufficient storage space.
7. If You use a spam filter that blocks or re-routes emails from senders not listed in Your email address book, You must add relevant SHAiR.CO email accounts to Your email address book.
   
   

• Accessibility
  If You are having problems viewing or accessing any communications, please contact us.

• Current Contact Information
  It is Your responsibility to keep Your contact information, including Your primary email address, current. You can update Your primary email address and other contact information by logging into Your Account using the Services. If You have trouble updating Your information, please use the live chat feature or contact us via email at contactus@shair.co. 
  
  

• Withdraw Consent
  You may decline to electronically sign this document and withdraw Your consent to sign this document electronically by contacting SHAiR.CO directly, which may delay transactions or may result in termination of your ability to use the Services. To withdraw electronic communications, please get in touch with us via email at contactus@shair.co. Your withdrawal of consent will be effective after SHAiR.CO has had a reasonable period of time to process Your withdrawal.

• Your Electronic Signature
  You will create an electronic signature. If SHAiR.CO requests You will execute Communications electronically. This electronic signature may be used for any and all agreements You agree to on behalf of the use of Services, such as but not limited to, Trip Agreements and Trip Extensions. You also agree that Communications that You or SHAiR.CO sign electronically will have the same legal effect as a signed physical document. I understand that the electronically stored copy of my signature, any written instruction or authorization, and any other document provided to me by SHAiR.CO is considered to be the true, accurate, and complete record, legally enforceable in any proceeding to the same extent as if such documents were originally generated and maintained in printed form.
  
  

• Consent
  By selecting the “I agree” button, I am signing and agreeing to these terms electronically. I agree that my electronic signature is the legal equivalent of my manual/handwritten signature on this document. By selecting “I agree” using any device, means, or actions, I consent to the legally binding terms and conditions of these terms. I further agree that my signature is as valid as if I signed the Terms of Service document in writing. I am also confirming that I am authorized to enter into this Agreement. If I am signing these terms on behalf of a minor, I represent and warrant that I am the minor’s parent or legal guardian.
  
  

I agree not to contest the admissibility or enforceability of the electronically stored copy of this document and any other documents. I agree to the terms and conditions of this document on behalf of myself or as the parent or legal guardian of the minor on whose behalf I am signing this document.

• Requesting Paper Copies
  You can request paper copies of electronic Communications from SHAiR.CO by sending an email to contactus@shair.co. In Your email, please specify the Communication You would like to receive in paper form and Your current mailing address. Any fees for such paper copies will be charged by SHAiR.CO. When You sign the document, You will receive a copy of this document via email and on Your SHAiR profile via the Services.
